Terms of Use Customer Portal

BMW M GmbH (Daimlerstrasse 19, 85748 Garching-Hochbrück, Munich, hereinafter “we”) provides customers with the “BMW Driving Experience Customer Portal” pursuant to these Terms of Use, including data protection provisions. The BMW Driving Experience Customer Portal is the official portal for the BMW and MINI Driving Experience, where users can obtain downloads from their event, view directions or manage their data.

1. Account
Use of the BMW Driving Experience Customer Portal is free of charge. Anyone can create an account (hereinafter “User”) who is 18 years of age and has booked or completed a training course offered by BMW and MINI Driving Experience Germany and has a corresponding participant code. When registering, the customer is required to provide us with accurate and complete information about his or her identity, and to update this information as soon as any changes occur. Your BMW Driving Experience Customer Portal account is not transferable. Only one account is allowed per person. If a customer has participated in more than one event, customer service can combine the respective attendances/registrations. BMW M GmbH reserves the right to refuse access to the customer portal to certain users, either temporarily or permanently, without giving reasons. Such a suspension shall be considered in the case of a breach of these Terms of Use. Holders of a BMW Driving Experience Customer Portal account are obligated to refrain from disclosing the data needed to use the portal to third parties. This includes, in particular, e-mail address, global customer ID and password.

2. Availability
The BMW Driving Experience Customer Portal may be temporarily unavailable due to maintenance or installations. BMW M GmbH endeavours to keep these downtimes to a minimum.

3. Provision of Media in the Customer Portal by BMW Driving Experience
At selected BMW Driving Experience events, photos and video footage are generated during the events in accordance with data protection regulations; these photos and videos are then uploaded to the customer portal.

The media made available in the portal is available for the User to download for a period of 4 weeks. After this period has elapsed this media will be deleted from the customer portal and it will no longer be possible to request or recover the deleted content retrospectively.

4. Data Protection
A BMW account is required to register on the BMW Driving Experience Customer Portal. This consists of an e-mail address and the User’s password. The BMW account can be used for multiple BMW Group services. The data of the user-specific BMW account cannot be viewed publicly by other Users. The BMW Driving Experience Customer Portal is an exclusive area for participants in BMW and MINI Driving Experience training courses. In order to verify that the User has taken part in a BMW and MINI Driving Experience training course, the User’s participant code received after booking the event is requested during the registration process. The participant code cannot be viewed publicly by other users in the BMW Driving Experience Customer Portal. During registration, the User’s personal data such as first name, last name, address supplement (street, house number, postal code) and telephone number are requested. This will not be displayed publicly for other Users. The User can change their account data and profile data at any time in the BMW Driving Experience Customer Portal settings.

5. Deletion of a BMW Driving Experience Customer Portal account
A BMW Driving Experience Customer Portal account can be deleted at any time by a User requesting that customer service delete their profile. To do so, the User simply needs to send an e-mail to customer service at info@bmw-drivingexperience.com with the subject “Delete my customer portal account” and specify the registered e-mail address.

In accordance with data protection regulations, the account will be deleted automatically if it has not been used for 3 years.

6. Changes
BMW M GmbH is entitled to change the BMW Driving Experience Customer Portal and these Terms of Use at any time and without giving reasons. Users of the BMW Driving Experience Customer Portal will be informed of significant changes when they log in and, where necessary, asked for their consent.

7. Final Provisions
These Terms of Use are subject to German law with the exclusion of the UN Purchase Law. This choice of law applies only to the extent that this does not obscure mandatory, applicable consumer protection regulations of the country in which the consumer lived at the time of their order. Exclusive court of jurisdiction for all claims arising from the business relationships with merchants is Munich. The same court of jurisdiction shall apply where the customer has no general court of jurisdiction within the territory of the country, their domicile or permanent address is relocated from their home country, or their domicile or permanent address is not known at the time at which the lawsuit is filed.
